This page (together with the documents referred to on it) tells you the terms of use on which you may make use of our website www.itskillsacademy.ac.uk (our site), whether as a guest, a registered user, or a subscriber. Information about us

www.itskillsacademy.ac.uk is a site operated by National Skills Academy for IT (“We”).  We are registered in England and Wales under company number 07223753 and our main trading address and contact address is 1 Castle Lane London SW1E 6DR. We are a not for profit company limited by guarantee with a registered office address at Victoria House, 39 Winchester Street, Basingstoke, Hampshire RG21 7EQ.

Accessing our site

National Skills Academy for IT hereby grants to visitors to this website access to these pages conditional upon your agreement to the following terms of usage and the terms of our privacy statement and acceptable use policy. Access to our site is permitted on a temporary basis. We will not be liable if for any reason our site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our site, or our entire site, to users including those who have registered with us.

Part of our site can be accessed only if you are a subscriber. Individuals who use the site as a subscriber must be UK residents.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable and delete any user account and all data linked to them, including identification code or passwords, whether chosen by you or allocated by us, at any time if in our opinion you have failed to comply with any of the provisions of these terms of use or if we believe there is or may be a security breach.  We also have the right to recoup all loss of income resulting from your failure to comply with any of the provisions of these terms of use.

Governing law

You hereby accept the application of the laws of England to govern matters between us in relation to this website and you agree to indemnify us and not hold us liable for the result of any actions you may take based on the information contained herein.

Neither National Skills Academy for IT nor any of its employees, agents or sub-contractors make any warranty, expressed or implied, or assume any legal liability or responsibility for the accuracy or completeness of any information contained on this site, or output from this site through print or file download (e.g. PDF), or any website referred to nor that these web pages will be free from errors or that its availability will be uninterrupted. National Skills Academy for IT does not warrant that the information on this site is suitable for the purposes for which you may need it or use it. National Skills Academy for IT cannot be held responsible for the contents of any pages referred to by an external link. Restrictions on use of website

The materials and information contained on this website (Content) and all copyright and other intellectual property rights therein belong to National Skills Academy for IT or its content providers. You are hereby granted permission to access the Site and print a copy of the page as a record of your visit. All other use of the Site and its Content, including modification, publication, transmission, creation of derivative works, incorporation into another website or reproducing the Site or the Content (whether by linking, framing or any other method) is not permitted without National Skills Academy for IT's prior written consent.

Posting or transmitting to or from this website any information or data in breach of the Content standard referred to below is prohibited.  You , the user, by posting uploading or transmitting any data onto this website hereby warrant that it does not breach the above and that you have full and unrestricted right to post upload or transmit such data.

Prohibited Uses

You may use our site only for lawful purposes. You may not use our site:

  • any equipment or network on which our site is stored;
  • any software used in the provision of our site; or

Content Standards

These content standards apply to any and all material or information which you contribute (either by posting uploading transmitting or otherwise)  to our site (contributions), and to any interactive services associated with it.

The Purchase of Products

Where applicable, the purchase of any products advertised on this site will be subject to the additional terms and conditions of purchase and where appropriate licence terms and the products are intended to be available only to those persons residing in the country or countries specified in the terms and conditions.

The content of the subscription bundle is liable to change without notice.  The National Skills Academy for IT is not liable for any claim in relation to a perceived loss of value.  

How the Contract is Formed Between You and Us

After placing an order, you will receive an e-mail acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to grant you a licence to use the online training tool and related services (Product). You will be required to make payment when submitting your order.  All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms payment and we will send you a sales invoice. Access to the Product will be given immediately upon acceptance by us of your order. The contract between us (Contract) will only be formed when we accept your order.

The Contract will relate only to those Products we have confirmed in the sales invoice.

Our Status

Please note that in some cases, we accept orders as agents on behalf of third party sellers. The resulting legal contract is between you and that third party seller, and is subject to the terms and conditions of that third party seller, which they will advise you of themselves. You should carefully review their terms and conditions applying to the transaction.

We may also provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking that products you purchase from third party sellers through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality or fit for purpose, and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against the third party seller. We will notify you when a third party is involved in a transaction, and you hereby agree that we may disclose your customer information related to that transaction to the third party seller.

Software Based Products

If you purchase a software based product either downloadable or to be accessed online then you are granted a limited licence to use the product subject to the relevant end user licence terms and conditions which appear below or will be accessible on the relevant download or access page.

Other than the limited licence no other rights are granted and ownership of the software and all intellectual property rights in the software including all goodwill associated with the software shall at all times remain vested in the National Skills Academy for IT or its licensors.

Cancellation

Consumer Rights: 

You may or may not have any right to cancel in the circumstances mentioned below. This provision does not affect your other statutory rights as a consumer

Software Products:

If you purchase a software product then by the very nature of the product and the fact that it is downloadable immediately or accessible immediately means that you do not have a right to cancel the purchase once the software has been downloaded or accessed as it cannot be returned.

Membership subscriptions:

If you have made this application as a consumer for your private use (and not for your business) you will have a right to cancel within 7 days of the day we confirm to you, our acceptance of your application. You may cancel by email to info@itskillsacademy.ac.uk or by post to The National Skills Academy for IT, 1 Castle Lane, London SW1E 6DR within the seven working day period. Thereafter you will have the right to cancel your subscription at any time by giving us 30 days notice by email to info@itskillsacademy.ac.uk or by post to The National Skills Academy for IT, 1 Castle Lane, London SW1E 6DR. No refunds shall be made for annual subscriptions paid in advance unless you cancelled the subscription within the 7 day period from day we confirm to you, our acceptance of your application as referred to above. The subscription period shall be for one year.

Information you submit to us

Personal information about you which you submit to us will be governed by the terms of our privacy statement. 

In relation to all other information you submit you hereby agree and warrant

o    that such material or information is not confidential or proprietary and National Skills Academy for IT shall be free to use any such information in any manner for any purpose without charge or liability to you and you agree not to take any action against National Skills Academy for IT in relation to the use of such material or information.

o    that you own or have unrestricted rights to the material or information submitted to National Skills Academy for IT and you shall indemnify and render National Skills Academy for IT harmless against any and all claims, suits proceedings, expenses, recoveries and damages including court costs and lawyers fees and expenses of any type whatsoever, brought against National Skills Academy for IT in connection with infringement of third party rights in respect of the material or information that you submitted.

o    to take reasonable steps to ensure that the material or information is free from any known computer viruses, or other contaminates, including but not limited to any code or instructions that may be used to modify damage disable or compromise the security of this website, or National Skills Academy for IT computer systems or networks.

o    That the information complies in all respects with our Content Standards.

Any breach by you of the above warranties or these terms and conditions or if in our opinion we believe you are in breach we may withdraw all data  and information submitted and deny access to you and any person you have allowed form all or any part of this site. If we are informed by any third party that you are in breach of any of the warranties or these terms and conditions then we may without further investigation withdraw all data and information submitted by you and deny access to you and any person you have allowed from all or any part of this site without liability to you. We may in our discretion reinstate access on evidence satisfactory to us that you have not breached any of the warranties or these terms and conditions.

 

Use of third party information:

Any data or information uploaded posted or otherwise transmitted onto this website by users or other third parties is not checked or verified for accuracy by National Skills Academy for IT nor are we under an obligation to do so. If you access such data or information and rely on it or use it then you do so at your own risk. National Skills Academy for IT does not guarantee or warrant that such data or information is accurate and not misleading, fit for purpose, available to you to use, free of any legal barriers to its use or otherwise and shall not be liable to you for any loss you may suffer as a result of your use or reliance on such data or information.

Use of online Tools

If you use any of the online tools available through this web site for example skills mapping, professional profile or otherwise which are designed to match your skills levels against industry norms or to identify potential skills shortages and locate potential training then the following provisions shall apply:

National Skills Academy for IT will use its reasonable endeavours to ensure that the database of training providers, courses and availability are current and up to date however as National Skills Academy for IT is reliant upon such information being provided and updated by third parties National Skills Academy for IT cannot guarantee the accuracy of such information.  Where these tools require you to input your personal skills profile or other specific information intended to be matched please note this information shall be matched against generic and sometimes statistical criteria which will provide you with a general guide only and National Skills Academy for IT cannot guarantee that this will be a comprehensive analysis of your current position.

Revisions

National Skills Academy for IT reserves the right to revise, withdraw or restrict access to the Content of this website in whole or in part at any time without prior notice. Please check this page periodically for changes. Your continued use of the National Skills Academy for IT site following the posting of changes to these Terms of Use means you accept the changes.

Terms and Conditions of use of Skillsoft material:

These apply on access to Skillsoft material provided as part of the National Skills Academy for IT subscription.

COURSEWARE LICENSE AGREEMENT

NB: In this document, “you” or “your” means the user of the Software and “SkillSoft” means the SkillSoft company serving the country where the Software is acquired.

BY USING THIS SOFTWARE, YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT AND CREATE A BINDING CONTRACT BETWEEN YOU AND SKILLSOFT.  IF YOU DO NOT AGREE TO THESE TERMS, YOU SHOULD EXIT FROM THIS COURSE AND RETURN THIS COURSE TO THE PERSON FROM WHOM YOU OBTAINED IT WITHIN THREE (3) DAYS OF RECEIPT AND OBTAIN A REFUND.

SKILLSOFT grants you a terminable non-exclusive, non-transferable license to use one copy of the enclosed software program (the “Software”) and accompanying documentation in accordance with the following terms and conditions.

You may use the Software only on a single stand-alone computer or a network node from which the Software cannot be accessed by another computer. You may make one (1) copy of the Software for back-up or archival purposes only.  If the Software is installed in a corporate or network environment it shall be used by no more than one (1) user unless the number of authorized copies or users of the Software is set out on this package or in a separate agreement with SkillSoft.  Software may be installed on a network server only for the purpose of distributing copies of the Software to other computers and for no other purpose whatsoever.   You will not: (a) copy the Software, except as provided above, (b) reverse engineer, disassemble or decompile the Software, (c) transfer or make available the Software to any other party, or (d) use the Software outside the country of acquisition.

The computer software, artwork and other components included in the Software are the copyrighted property of SkillSoft and its licensors.  The Software is licensed (not sold) to you, and SkillSoft owns all copyright, trade secret, patent and other proprietary rights in the Software.  You may use the Software on a single computer.  You may not:  (1) copy (other than once for back-up purposes), distribute, rent, loan, lease or sublicense all or any portion of the Software; (2) modify, translate, distribute or prepare derivative works of the Software or the accompanying documentation; (3) reverse engineer, decompile or disassemble the Software or the accompanying documentation; or (4) remove any proprietary notices, labels, or marks on the Software and accompanying documentation.  You may not transfer the Software. Your license is automatically terminated if you transfer the Software.

THIS LICENSE IS NOT A SALE.  TITLE AND COPYRIGHTS TO THE SOFTWARE, ACCOMPANYING DOCUMENTATION AND ANY COPY MADE BY YOU REMAIN WITH SKILLSOFT OR ITS LICENSORS, AS THE CASE MAY BE. 

CONFIDENTIALITY - The Software contains confidential trade secret information belonging to SKILLSOFT, and you may use the Software only pursuant to the license set forth herein.  In addition, you may not disclose the Software to any third party.

SkillSoft  warrants to you that the media furnished in this product will be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of purchase.

You expressly acknowledge and agree that use of the Software is at your sole risk.  Except for the limited ninety (90) day warranty on the media set forth above, the Software and any related documentation or materials are provided "AS IS" and without warranty of any kind.  SKILLSOFT EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.  SKILLSOFT DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS DEPENDING ON THE LAWS IN YOUR STATE.  YOU AGREE THAT THE LIABILITY OF SKILLSOFT ARISING OUT OF ANY KIND OF LEGAL CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL NOT EXCEED THE AMOUNT YOU ORIGINALLY PAID FOR THE USE OF THE SOFTWARE.

U.S.A. ONLY.  If the Software is acquired under agreement with the U.S. government or any contractor therewith, it is acquired as "commercial computer software" subject to the provisions hereof, as specified in 48 CFR 12.212 of the FAR and, if acquired for Department of Defense (DoD) units, 48 CFR 227-7202 of the DoD FAR Supplement, or sections succeeding thereto.

This License is governed by the laws of the jurisdiction of the SkillSoft Company serving the country where the Software was acquired.  If any provision of this license is not enforceable, it will be served from this license and the remainder will remain in full force and effect.

Terms and Conditions of use of Books 24/7:

These apply on access to Books 24/7 material provided as part of the National Skills Academy for IT subscription.

BOOKS24X7.COM MEMBERSHIP AGREEMENT

IMPORTANT NOTICE: TO BECOME AN AUTHORIZED USER OF BOOKS24X7.COM, YOU MUST AGREE TO THE TERMS OF THIS MEMBERSHIP AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS MEMBERSHIP AGREEMENT, YOU SHOULD RETURN TO THE PRECEDING SCREEN. IN THE EVENT YOU HAVE ALREADY ENTERED INTO AN AGREEMENT WITH A LICENSOR OF BOOKS24X7.COM PRODUCTS ("MASTER AGREEMENT") AND THERE IS A CONFLICT BETWEEN THE FOLLOWING TERMS AND CONDITIONS AND THE MASTER AGREEMENT, THE MASTER AGREEMENT SHALL GOVERN.

THE SERVICE. Books24x7.com is an online library of third party reference materials, editorial materials, electronic books and other resources offered by Books24x7.com, Inc. ("B24x7"), or its affiliates, subsidiaries or parent company. The content, services, programs and hours of operation of Books24x7.com may be expanded, restricted, updated or otherwise changed by B24x7 in its sole discretion at any time.

PROPRIETARY RIGHTS. All content included on this site is the property of third party publishers or B24x7 and is protected by copyright and other laws relating to proprietary rights. All software used on this site is the property of B24x7 or its software suppliers and is protected by copyright and other laws. B24x7 and its content providers and software suppliers retain all rights in their respective properties worldwide.

PERSONAL PASSWORD; RESPONSIBILITY FOR USE; RIGHT TO TERMINATE. As an Authorized User, You will have a User Name and Personal Password that will enable You to access Books24x7.com through Your Internet access provider. You may not share, disclose or transfer Your Personal Password with or to any third party. If You believe that the security of Your Personal Password has been breached, You must promptly notify B24x7 of the breach. B24x7 will then cancel that password and issue You a new Personal Password. You are responsible for ensuring that all use of Books24x7.com under Your User Name and Personal Password complies with this Membership Agreement, and You agree to indemnify and hold B24x7, its affiliates, agents, employees, directors and suppliers harmless against any damages, costs or expenses arising out of Your improper use of Books24x7.com and the use by others of Books24x7.com under Your User Name and Personal Password. B24x7 reserves the right to cancel Your Personal Password, and thereby Your access to Books24x7.com at any time without refund if You fail to comply with the terms of this Membership Agreement or if B24x7, in its sole discretion, deems Your conduct in connection with Your use of Books24x7.com to be unacceptable.

LIMITATIONS ON USE. Your use of Books24x7.com is expressly subject to the restrictions set forth below. If B24x7 detects or becomes aware of any failure to comply with any of these restrictions, it may terminate Your access to Books24x7.com immediately without refund.

1. You may not reproduce, retransmit, distribute, disseminate, sell, license, sublicense, lease, publish, broadcast or circulate any content or other materials accessed through Books24x7.com, except in accordance with the fair use doctrine under the copyright laws of the United States.
2. Access to Book24x7.com servers is restricted to conventional non-accelerated browsers. You may not use any product, browser or browser feature that significantly accelerates the speed of page downloads, such as NetJet, NetSonic, MSIE Crawler or Teleport-Pro.
3. You may not use web robots, crawlers, wanderers or spiders in connection with Books24x7.com.
4. DOWNLOADING CONTENT. Depending on the nature of your subscription, You may be entitled to download certain content, chapters or chapter-type content as indicated on the site by a download link. Depending on the content, you may or may not be limited to a specific number of downloads per title as designated on the site's download page. These downloads can be printed or stored on your hard drive for your personal use only and cannot be shared with others. You are authorized to use the downloads only during your paid subscription period and are required to delete and/or otherwise discard any content you have downloaded from the site when your subscription to Books24x7 is no longer active.

TRIAL PERIOD. In the event Your access to the Books24x7.com is a trial event, You are bound by the terms and conditions of this Membership Agreement.

DISCLAIMERS. BOOKS24X7.COM AND ITS CONTENT ARE BEING PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND. B24X7, ITS AFFILIATES, AGENTS EMPLOYEES, DIRECTORS, AND SUPPLIERS EXPRESSLY DISCLAIM ANY SUCH WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM INFRINGEMENT OR FREEDOM FROM VIRUSES. B24X7 DOES NOT WARRANT THAT THE OPERATION OF BOOKS24X7.COM WILL BE ERROR FREE OR WITHOUT INTERRUPTION. ALL LIABILITY WITH RESPECT TO THE ACCURACY, RELIABILITY AND/OR QUALITY OF THIRD PARTY CONTENT SHALL REMAIN WITH THE RESPECTIVE CONTENT PROVIDER, AND YOU SHALL HAVE NO REMEDY AGAINST B24x7 WITH RESPECT TO THE SAME.

You understand that any use of Books24x7.com and any of the content is entirely at Your own risk. You agree to take appropriate measures to safeguard Your data and information from Books24x7.com malfunctions.
